Terms and Conditions of Use
By using the Älyenergia application (hereinafter “Application”), the user undertakes to comply with these terms of use.
The use shall have a right to use the Application in accordance with user instructions published from time to time by Vihreä Älyenergia Oy and these terms of use. The right to use is not sublicensable or transferable.
Vihreä Älyenergia Oy is not responsible for the accuracy of the price information in the Application and does not guarantee the continuous functionality of the Application. Electricity price information is information produced by Nord Pool Spot or other third parties and shared by Vihreä Älyenergia Oy through the Application. Vihreä Älyenergia Oy has the right to restrict the use of the Application at any time, change its content, or cease its operation.
All intellectual property rights related to the Application or its content (e.g. copyrights, registered and unregistered trademark and design rights, and domain names) belong to Vihreä Älyenergia Oy or its partners or parties otherwise appearing in the Application. Your use of the Application does not grant you any intellectual property rights in any information or content contained in the Application.
The Application allows devices to be linked to the Application through a third-party service. Vihreä Älyenergia Oy cannot guarantee that every device will work perfectly with the Application. By using the Application, you give us permission to use your devices to provide our services. You may terminate this access at any time through the Application or by contacting us. Vihreä Älyenergia Oy is not responsible for any material contained in third-party websites, applications or services, their reliability or data security. Third parties have their own terms of use and privacy policies, which you should familiarize yourself with when connecting devices to enable the services.
Vihreä Älyenergia Oy collects and processes personal data relating to the Application in accordance with a privacy policy available at its website.
Vihreä Älyenergia Oy is not responsible for the correctness of the information or content transmitted in the Application. Vihreä Älyenergia Oy is not responsible for damage caused by the use or reliance on the information and content presented. Vihreä Älyenergia Oy is also not responsible for any damage caused to the user due to the incorrect or inadequate operation of the Application.
These terms of use enter into force on 31 July 2024 and are valid until further notice. These terms of use were last updated on 31 July 2024. Vihreä Älyenergia Oy has the right to unilaterally amend or replace these terms of use. The user shall be considered to have accepted the amended or replaced terms of use if the user continues the use of the Application after the amended or replaced terms of use have become effective. The date on which the terms of use were last modified shall be stated in connection with the terms of use.
These terms of use and any disputes arising from the Application, its content or use shall be governed by Finnish law, excluding choice of law provisions. All disputes will be submitted to the district court of the domicile of Vihreä Älyenergia Oy as the court of first instance.
However, a consumer has a right to file a lawsuit in the district court of the consumer’s domicile, in addition to which the consumer can also refer the dispute to the Consumer Disputes Board.
These terms of use do not limit the statutory, mandatory responsibilities and obligations of Vihreä Älyenergia Oy towards consumers.
